These Terms of Use (“Terms”) are a binding agreement between you and Mark Marez, an individual sole proprietor doing business as Vocal Light (“Vocal Light,” “we,” “us,” or “our”). These Terms govern your access to and use of the Vocal Light mobile application, its generated sounds, displays, features, documentation, and related materials (collectively, the “App”).

Please read these Terms, the Vocal Light Liability Waiver, Assumption of Risk, Release, and Covenant Not to Sue (“Waiver”), the Privacy Policy, and the Consumer Health Data Privacy Policy carefully. By checking the conspicuous combined Terms-and-Waiver assent box and tapping Agree & Continue, you affirmatively agree to both these Terms and the separate Waiver. The separate Voice and Playback Safety acknowledgment confirms that you read that notice. If you do not agree, do not use the App.

1. Eligibility and United States-only offering

The App is offered only to individuals who:

  • Are at least 18 years old;
  • Have the legal capacity to enter a binding agreement; and
  • Are located in the United States.

The App is not offered to minors. A parent or guardian may not accept these Terms or the Waiver on behalf of a minor. If you are under 18, do not use the App.

2. Relationship to Apple’s Standard EULA

The App is licensed, not sold. Unless a custom end-user license agreement is later posted for the App in App Store Connect, Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”) governs the license delivered through the App Store.

These Terms supplement the Apple Standard EULA. The Apple Standard EULA controls solely to the extent of an irreconcilable conflict concerning the App Store license. These Terms, the Waiver, the Privacy Policy, and the in-app safety notices govern the additional relationship between you and Vocal Light, including safe-use obligations, practice limitations, privacy disclosures, and allocation of risk.

3. Singing-practice aid only

Vocal Light is a general wellness and singing-practice aid. It estimates pitch, cents, timing, vocal-range information, note shapes, chords, and related practice information. It may also generate reference notes, chords, rhythms, or other sounds.

The voice-category slider immediately applies and stores the selected approximate practice range. A saved range is also used to choose the register of generated piano notes and chord voicings. The optional range analyzer asks you to choose and separately repeat one comfortable low note and one comfortable high note for your review. Neither a preset nor an analyzer result determines your physiological limits, voice type, health, technique, or whether any note is safe or comfortable for you.

The App is not:

  • A medical device or medical service;
  • Medical advice, diagnosis, treatment, monitoring, rehabilitation, or injury prevention;
  • Voice therapy, speech-language pathology, audiology, or emergency assistance;
  • A substitute for a physician, otolaryngologist, audiologist, speech-language pathologist, qualified voice professional, or other appropriate professional; or
  • A promise that any exercise, note, range, duration, technique, or playback level is safe or appropriate for you.

Do not use the App to make medical, safety-critical, employment, educational-placement, audition, legal, or emergency decisions. If you have persistent hoarseness, pain, hearing changes, breathing difficulty, or another health concern, stop using the App and seek advice from an appropriate qualified professional. Call emergency services when circumstances require immediate assistance.

4. Voice and physical safety

Singing and range exploration involve physical effort and can cause or aggravate injury. You are solely responsible for deciding whether, when, where, and how to practice.

You agree to:

  • Sing only notes, volumes, durations, and exercises that feel comfortable;
  • Avoid forcing your highest or lowest possible note;
  • Use only easy, repeatable boundary notes in the range analyzer, stop rather than continuing to satisfy a prompt, and reject or restart any result that felt effortful or appears incorrect;
  • Review the displayed range after moving the slider, entering notes, or using the analyzer because the change immediately affects the register of generated reference notes and chords;
  • Warm up gradually and take reasonable breaks;
  • Avoid practice while hoarse, ill, unusually tired, strained, dizzy, short of breath, or in pain;
  • Stop immediately for pain, strain, burning, hearing discomfort, ringing in the ears, dizziness, shortness of breath, faintness, or other unusual symptoms; and
  • Remain aware of your surroundings and never use the App while driving, operating machinery, or performing an activity that requires undivided attention.

No instruction, preset, range label, analyzer result, warning, or software feature makes singing risk-free.

5. Audio playback, iPhone volume, and route limitations

Generated reference audio can be uncomfortable or harmful at excessive levels. Start with the device media volume at its lowest practical setting, then increase it slowly only if needed.

The value labeled iPhone reports Apple’s user-controlled, shared device media-volume setting. It is read-only inside Vocal Light and may also affect other apps. Vocal Light does not programmatically set or lower it. Vocal Light is designed to stop its generated reference playback when iOS reports that this shared setting exceeds 50 percent; this App-local cutoff does not lower the shared setting, does not control another app, and may be delayed, unavailable, or inaccurate because of route or operating-system behavior. The separate Vocal Light Volume control attenuates only Vocal Light’s generated reference audio from silence to the App’s bounded maximum; it provides no positive-gain boost above that maximum and cannot control another app. Neither the displayed iPhone percentage nor either control position measures sound-pressure level at your ear, establishes a safe exposure, or accounts for headphone sensitivity, speaker amplification, distance, duration, or individual susceptibility.

On supported iPhones, the user may separately configure Apple’s Reduce Loud Audio feature, including an 85 dB selection, in Settings > Sounds & Haptics > Headphone Safety. Vocal Light cannot enable, inspect, enforce, or guarantee that system setting. Apple indicates that headphone-level measurements are most accurate with compatible Apple or Beats headphones and may be estimated for other headphones.

Vocal Light may use equalization, serial compression, parallel compression, soft clipping, limiting, route-specific gain, and system audio processing to make its generated sound easier to hear without increasing the shared device setting. These processes can increase average loudness, alter tone, or produce distortion and do not make any device-volume setting safe.

The current build is intended to permit generated reference audio through the built-in speaker and detected wired or Bluetooth personal-audio routes, using route-specific bounded output profiles, and to block detected AirPlay, car, USB, line-out, mixed, unknown, and other amplified routes. Bluetooth route type, route classification, and route changes can be delayed, incomplete, or wrong. Hardware, iOS, accessories, and another app may behave differently than expected. When the route changes, Vocal Light is designed to stop its own reference sound and require a new playback tap.

Vocal Light uses an App-local render gate, mixer mute, supported audio-session muting, engine shutdown, and audio-session deactivation when iOS reports that the App is becoming inactive, backgrounded, interrupted, or terminated. These layers can fail, be delayed, or behave differently across devices and operating-system versions. They do not lower the shared device media volume and do not control another app, accessory amplifier, car system, speaker, or headphone.

Before using reference audio, changing routes, switching apps, removing headphones, connecting equipment, or handing the device to another person, independently check and lower the actual device and equipment volume. Never rely on Vocal Light as hearing-protection equipment or as a guarantee that another app will open quietly.

6. Estimated output and no reliance

All App measurements, classifications, displays, and suggestions are estimates. Outputs may be delayed, unstable, incomplete, or wrong because of microphone characteristics, room acoustics, background noise, accompaniment, speaker bleed, clipping, vocal tone, breath noise, vibrato, overtones, octave ambiguity, device processing, route changes, software limitations, or other conditions.

In particular, the App may:

  • Display the wrong note, octave, cents value, range, chord, or timing;
  • Fail to detect a note;
  • Continue displaying stale information;
  • Interpret an instrument or overtone as a voice;
  • Reject a valid sung note; or
  • Produce different results for performances that sound similar.

Repeating a note, receiving a confirmation, or seeing a completed comfortable-range result reduces neither the physical risks of singing nor the possibility of a detection, octave, or transcription error. The App cannot sense pain, fatigue, effort, illness, strain, or whether you intentionally selected a comfortable boundary.

The optional Guitar/Piano live-input mode uses heuristic pitch-candidate scoring to try to follow a singer through live acoustic accompaniment. It does not perform guaranteed stem separation or vocal isolation. It may track an instrument, overtone, or wrong octave; reject a valid sung note; or stop reporting pitch when the mixture is too ambiguous. Keep the microphone closer to the voice than the instrument and independently judge every result.

You are responsible for independently evaluating App output before relying on it for any non-practice purpose. The App is not a calibrated tuner, laboratory instrument, or guaranteed professional measurement system.

7. Permission to use the App

Subject to these Terms and the Apple Standard EULA, you may use the App for your personal, noncommercial singing practice. No ownership interest in the App or its content is transferred to you.

You may not:

  • Copy, distribute, sell, rent, lease, sublicense, publicly perform, or commercially exploit the App except as applicable law expressly permits;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent a non-waivable law permits;
  • Circumvent security, route restrictions, safety controls, or technical limits;
  • Interfere with the App’s operation or another person’s device;
  • Use the App to violate law, infringe intellectual-property or privacy rights, or facilitate harmful conduct;
  • Misrepresent App output as medical, clinical, guaranteed, or professionally certified; or
  • Remove proprietary notices.

8. Your audio and other materials

Vocal Light does not claim ownership of your voice, performance, or other sounds processed for live, on-device analysis. You remain responsible for performing or playing only material you may lawfully use and for respecting applicable intellectual-property, privacy, confidentiality, and publicity rights.

9. Ownership and third-party materials

As between you and Vocal Light, Vocal Light and its licensors retain all right, title, and interest in the App, software, designs, text, graphics, audio synthesis, documentation, trademarks, and other materials, excluding content owned by you or a third party.

Third-party software remains subject to its applicable license. Open-source notices are available in the App’s Legal & Privacy screen.

10. Privacy

The Vocal Light Privacy Policy and Consumer Health Data Privacy Policy explain the App’s microphone access, on-device processing, local storage, retention, deletion, and current no-tracking/no-server design. Those policies are incorporated into these Terms for notice purposes, but your agreement to these Terms is not treated as microphone-processing consent or as consent to any future data practice that applicable law requires to be presented separately.

Microphone processing and iOS microphone permission are optional, but live pitch and measured-range features cannot function without them. Within the initial Legal & Privacy flow, the App presents a dedicated microphone-processing disclosure and separate unchecked consent row identifying the categories processed, specific purposes, absence of recipients or sharing, and withdrawal method. This microphone consent is distinct from the combined Terms-and-Waiver assent control even though the controls appear in the same flow. If you opt in there, iOS may ask for microphone permission immediately after onboarding; if you opt in later, iOS may ask when you first choose a microphone feature. Vocal Light does not show another custom consent screen. No microphone capture begins until you affirmatively start Sing or range measurement. You can withdraw processing consent in Legal & Privacy, stop microphone processing in the App, or revoke microphone permission in iOS Settings.

11. Updates and changes

We may provide bug fixes, safety changes, feature changes, or updates. An update may be necessary for continued compatibility or safe operation. We may discontinue all or part of the App, subject to non-waivable law and any rights administered by Apple.

We may revise these Terms prospectively. Material revisions will receive a new version identifier and will be presented for renewed affirmative assent before continued use where required. A change will not retroactively eliminate a claim that applicable law does not permit us to eliminate.

12. Suspension and termination

Your permission to use the App ends automatically if you materially breach these Terms. Upon termination, stop using the App and delete it. Sections that by their nature should survive—including ownership, disclaimers, limitations, dispute terms, and the Waiver—survive to the extent permitted by law.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS. VOCAL LIGHT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AVAILABILITY, SECURITY, AND SAFETY.

Without limiting the foregoing, Vocal Light does not warrant that the App will be uninterrupted, error-free, compatible with every device or route, accurate, sufficiently loud, free from harmful volume, or appropriate for any particular person or use.

This disclaimer does not exclude a warranty or consumer right that applicable law does not permit to be excluded.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOCAL LIGHT AND THE RELEASED PARTIES DEFINED IN THE WAIVER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE APP, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF VOCAL LIGHT AND THOSE RELEASED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACQUIRE THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS.

The Waiver separately addresses assumption of risk, release of defined claims based on ordinary negligence, and a covenant not to sue. Nothing in these Terms or the Waiver excludes or limits liability for gross negligence, recklessness, willful misconduct, fraud, intentional injury, violation of law, or any warranty, remedy, personal-injury claim, product-liability claim, or consumer right that applicable law does not permit to be excluded, released, or limited.

Some jurisdictions do not allow certain exclusions or limits. In that event, the affected provision applies only to the maximum extent permitted by law.

15. Narrow indemnity for unlawful conduct

To the maximum extent permitted by law, you will defend and indemnify Vocal Light against a third-party claim to the extent the claim is caused by your intentional unlawful conduct, your willful infringement of the third party’s intellectual-property rights, or your material misuse of the App in violation of these Terms.

This section does not require you to indemnify Vocal Light for Vocal Light’s own negligence, product defect, violation of law, or injury arising from ordinary consumer use of the App.

16. Governing law and disputes

California law governs these Terms and the Waiver, without regard to conflict-of-law rules, except that non-waivable law of your state of residence applies where required.

Before filing a civil action, either party may request a good-faith informal discussion by using the Support URL on the App Store product page. Informal discussion is voluntary and does not shorten or waive a legal deadline.

Any dispute not resolved informally may be brought in a court that has personal and subject-matter jurisdiction. These Terms do not require mandatory arbitration and do not waive any right that applicable law makes non-waivable.

Nothing in these Terms prevents you from communicating with, filing a complaint with, or participating in a proceeding before a government agency.

17. General terms

These Terms, the Waiver, the Privacy Policy, the Consumer Health Data Privacy Policy, the Apple Standard EULA, and any additional terms presented for a specific feature constitute the agreement governing your use of the App.

If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain in effect, unless doing so would materially defeat the parties’ bargain. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a sale, reorganization, or transfer of the App, subject to applicable law.

Headings are for convenience only. “Including” means “including without limitation.” The singular includes the plural where context permits.
