Vocal Light Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and the provider identified in the App’s Legal & Privacy provider notice and Apple Standard EULA Notice, operating under the business name Vocal Light (“Vocal Light,” “we,” “us,” or “our”). Vocal Light is a business name, not a separate legal entity. These Terms govern your access to and use of the Vocal Light mobile application, its generated sounds, displays, features, documentation, and related materials (collectively, the “App”).

Please review these Terms and the separate Liability Waiver, Assumption of Risk, Release, and Covenant Not to Sue (“Waiver”). The welcome screen links to these documents and the Voice and Playback Safety Notice before you agree. Separate unchecked boxes ask you to accept the Terms and Waiver and acknowledge the Safety Notice. Selecting them and tapping Accept & Continue electronically signs your agreements. The Waiver describes the risks you assume and the claims you release where permitted by law. Privacy notices explain data practices; accepting these Terms does not itself give voice-processing consent. If you do not agree, do not use the App.

1. Eligibility and United States-only offering

The App is offered only to individuals who:

  • Are at least 18 years old;
  • Have the legal capacity to enter a binding agreement; and
  • Are located in the United States.

The App is not offered to minors. A parent or guardian may not accept these Terms or the Waiver on behalf of a minor. If you are under 18, do not use the App.

2. Relationship to Apple’s Standard EULA

The App is licensed, not sold. Unless a custom end-user license agreement is later posted for the App in App Store Connect, Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”) governs the license obtained through the App Store.

These Terms and the Waiver are separate agreements between you and Vocal Light concerning use of the App, safety responsibilities, and allocation of risk. They do not modify Apple’s rights or obligations. If a conflict concerning the App Store license cannot be reconciled, the Apple Standard EULA controls to the extent applicable.

3. Purchase, billing, and refunds

For App Store customers, the public release is offered as a one-time paid download. It does not include an auto-renewing subscription or in-app purchase. TestFlight access is pre-release access rather than a sale. Apple processes App Store transactions, payment methods, taxes, and receipts under Apple’s terms and applicable non-waivable law. Vocal Light does not receive your payment-card or Apple Account credentials from the App.

The price shown by Apple when you confirm a purchase is the price that applies to that transaction, subject to Apple’s terms, taxes, and mandatory consumer rights. Refund eligibility is determined under Apple’s policies and applicable law. You may request an App Store refund through Apple’s available channels, including reportaproblem.apple.com or Apple Support. Contact Vocal Light if Apple directs you to us or if applicable law provides another remedy. Nothing in these Terms limits a refund, cancellation, warranty, or other remedy that applicable law does not permit you to waive.

First use requires separate affirmative acceptance of these Terms and the Waiver. If you acquire the App and do not agree, do not use it. You may close the App without accepting and request a refund through Apple’s channels described above; eligibility is subject to Apple’s policies and applicable law.

4. Music practice and estimated feedback

Vocal Light is a music-practice tool for pitch feedback, range exploration, and reference sounds. It estimates notes, cents, timing, and other practice information. It does not provide medical advice or a professional vocal assessment.

With your separate voice-and-range processing consent, choosing a range saves it on your device and changes the octave used for reference playback. Without that consent, playback uses an unsaved default range. The optional analyzer asks you to repeat a comfortable low and high note for your review. Presets and detected ranges are estimates, not a determination of your voice type, physical limits, health, or comfort.

The App is not:

  • A medical device or medical service;
  • Medical advice, diagnosis, treatment, monitoring, rehabilitation, or injury prevention;
  • Voice therapy, speech-language pathology, audiology, or emergency assistance;
  • A substitute for a physician, otolaryngologist, audiologist, speech-language pathologist, qualified voice professional, or other appropriate professional; or
  • A promise that any exercise, note, range, duration, technique, or playback level is safe or appropriate for you.

Do not use the App to make medical, safety-critical, employment, educational-placement, audition, legal, or emergency decisions. If you have persistent hoarseness, pain, hearing changes, breathing difficulty, or another health concern, stop using the App and seek advice from an appropriate qualified professional. Call emergency services when circumstances require immediate assistance.

5. Voice and physical safety

Singing and range exploration involve physical effort and can cause or aggravate injury. You are solely responsible for deciding whether, when, where, and how to practice.

You agree to:

  • Sing only notes, volumes, durations, and exercises that feel comfortable;
  • Avoid forcing your highest or lowest possible note;
  • Use only easy, repeatable boundary notes in the range analyzer, stop rather than continuing to satisfy a prompt, and reject or restart any result that felt effortful or appears incorrect;
  • Review the displayed range after moving the slider, entering notes, or using the analyzer because the change immediately affects the register of generated reference notes and chords;
  • Warm up gradually and take reasonable breaks;
  • Avoid practice while hoarse, ill, unusually tired, strained, dizzy, short of breath, or in pain;
  • Stop immediately for pain, strain, burning, hearing discomfort, ringing in the ears, dizziness, shortness of breath, faintness, or other unusual symptoms; and
  • Remain aware of your surroundings and never use the App while driving, operating machinery, or performing an activity that requires undivided attention.

No instruction, preset, range label, analyzer result, warning, or software feature makes singing risk-free.

6. Audio playback, iPhone volume, and route limitations

Generated reference audio can be uncomfortable or harmful at excessive levels. Start with the device media volume at its lowest practical setting, then increase it slowly only if needed.

iPhone displays the shared device volume; Vocal Light does not set or lower that setting. Vocal Light Volume adjusts only this App’s reference sounds. Other apps and connected equipment have their own playback behavior.

Playback loudness depends on your device, connected equipment, and settings. Start low and adjust gradually. Volume percentages are not measurements of sound level at your ears; listening duration and individual sensitivity also matter. The App’s volume limits are not hearing protection.

For headphones, consider turning on Apple’s Reduce Loud Audio in Settings > Sounds & Haptics > Headphone Safety. You manage that setting in iOS; Vocal Light does not enable or verify it.

Playback is intended for the built-in speaker and supported headphones. Some other connections are blocked. Connection detection can be wrong or delayed, so check the actual output destination and lower its volume before playing a sound. Connecting equipment does not itself start playback.

When a connection changes or iOS reports that the App is becoming inactive or interrupted, Vocal Light is designed to stop its own sounds. This can be delayed or fail. It does not turn down the shared iPhone volume or another app.

Before using reference audio, changing routes, switching apps, removing headphones, connecting equipment, or handing the device to another person, independently check and lower the actual device and equipment volume. Never rely on Vocal Light as hearing-protection equipment or as a guarantee that another app will open quietly.

7. Estimated output and no reliance

All App measurements, classifications, displays, and suggestions are estimates. Outputs may be delayed, unstable, incomplete, or wrong because of microphone characteristics, room acoustics, background noise, accompaniment, speaker bleed, clipping, vocal tone, breath noise, vibrato, overtones, octave ambiguity, device processing, route changes, software limitations, or other conditions.

In particular, the App may:

  • Display the wrong note, octave, cents value, range, chord, or timing;
  • Fail to detect a note;
  • Continue displaying stale information;
  • Interpret an instrument or overtone as a voice;
  • Reject a valid sung note; or
  • Produce different results for performances that sound similar.

Repeating a note, receiving a confirmation, or seeing a completed comfortable-range result reduces neither the physical risks of singing nor the possibility of a detection, octave, or transcription error. The App cannot sense pain, fatigue, effort, illness, strain, or whether you intentionally selected a comfortable boundary.

Live pitch detection in the public App is designed for one unaccompanied voice. Simultaneous instruments, recorded music, nearby speech, room noise, or App-generated playback can be mistaken for the singer or can prevent a note from being detected. Use a quiet space, let a reference sound fade before singing when practical, and independently judge every result.

You are responsible for independently evaluating App output before relying on it for any non-practice purpose. The App is not a calibrated tuner, laboratory instrument, or guaranteed professional measurement system.

8. Permission to use the App

Subject to these Terms and the Apple Standard EULA, you may use the App for lawful music practice, including professional preparation, adult teaching, and demonstrations. You may show the App and include its generated reference sounds in your own lawful lessons, recordings, or demonstration videos, including monetized content. These permissions do not authorize sharing or reselling the software or override Apple’s device and license rules. No ownership of the App transfers to you.

You may not:

  • Copy, redistribute, sell, rent, lease, or sublicense the software except as authorized by its license or applicable law;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent a non-waivable law permits;
  • Circumvent security, route restrictions, safety controls, or technical limits;
  • Interfere with the App’s operation or another person’s device;
  • Use the App to violate law, infringe intellectual-property or privacy rights, or facilitate harmful conduct;
  • Misrepresent App output as medical, clinical, guaranteed, or professionally certified; or
  • Remove proprietary notices.

9. Your audio and other materials

Vocal Light does not claim ownership of your voice, performance, or other sounds processed for live, on-device analysis. You remain responsible for performing or playing only material you may lawfully use and for respecting applicable intellectual-property, privacy, confidentiality, and publicity rights.

10. Ownership and third-party materials

As between you and Vocal Light, Vocal Light and its licensors retain all right, title, and interest in the App, software, designs, text, graphics, audio synthesis, documentation, trademarks, and other materials, excluding content owned by you or a third party.

Third-party software remains subject to its applicable license. Open-source notices are available in the App’s Legal & Privacy screen.

11. Privacy

The Vocal Light Privacy Policy and Consumer Health Data Privacy Policy explain the App’s microphone access, on-device voice-and-range processing, local storage, retention, deletion, and current no-tracking/no-server design. Those policies are notices rather than contracts. Your agreement to these Terms is not voice-and-range processing consent and is not consent to any future data practice that applicable law requires to be presented separately.

Voice-and-range processing consent is optional and separate from the Terms and Waiver. The welcome screen offers an unchecked consent box and a Voice & Range Privacy document link explaining the data, purposes, recipients, and withdrawal controls. A fuller disclosure is shown in Legal & Privacy if you choose to allow processing there later. Without consent, reference playback uses an unsaved default range; range changes and microphone features remain unavailable. Microphone capture also requires you to start Sing or measurement and grant iOS permission. Agreeing or granting permission alone does not start capture. You can withdraw processing consent or delete the associated data in Legal & Privacy and manage microphone permission in iOS Settings.

The separate optional consent covers a vocal category or comfortable low and high notes that you enter manually, along with live microphone audio and information derived from it when you start a microphone feature. Those settings remain on the device and may be withdrawn or deleted through Legal & Privacy.

12. Updates and changes

We may provide bug fixes, safety changes, feature changes, or updates. An update may be necessary for continued compatibility or safe operation. We may discontinue all or part of the App, subject to non-waivable law and any rights administered by Apple.

We may revise these Terms prospectively. Material revisions will receive a new version identifier and will be presented for renewed affirmative assent before continued use where required. A change will not retroactively eliminate a claim that applicable law does not permit us to eliminate.

13. Suspension and termination

Your permission to use the App ends automatically if you materially breach these Terms. Upon termination, stop using the App and delete it. Sections that by their nature should survive—including ownership, disclaimers, limitations, dispute terms, and the Waiver—survive to the extent permitted by law.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS. VOCAL LIGHT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AVAILABILITY, SECURITY, AND SAFETY.

Without limiting the foregoing, Vocal Light does not warrant that the App will be uninterrupted, error-free, compatible with every device or route, accurate, sufficiently loud, free from harmful volume, or appropriate for any particular person or use.

This disclaimer does not exclude a warranty or consumer right that applicable law does not permit to be excluded.

15. Limitation of liability

For this Section, “Excluded Claims” means claims involving gross negligence, recklessness, willful misconduct, fraud, intentional injury, a violation of law that cannot be waived, or any consumer, warranty, personal-injury, product-liability, or other remedy that applicable law does not permit to be excluded or limited.

EXCEPT FOR EXCLUDED CLAIMS, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOCAL LIGHT AND THE RELEASED PARTIES DEFINED IN THE WAIVER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE APP, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

EXCEPT FOR EXCLUDED CLAIMS, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF VOCAL LIGHT AND THOSE RELEASED PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP THAT DO NOT INVOLVE PERSONAL INJURY, DEATH, PHYSICAL PROPERTY DAMAGE, OR A NON-WAIVABLE STATUTORY REMEDY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACQUIRE THE APP OR (B) FIFTY U.S. DOLLARS.

This is an aggregate cap for eligible claims, not a separate cap for each claim. It does not cap personal injury, death, physical property damage, or any Excluded Claim. The separate Waiver addresses whether particular ordinary-negligence claims may be released; neither agreement guarantees that a claim can be barred or limited.

The Waiver separately addresses assumption of risk, release of defined claims based on ordinary negligence, and a covenant not to sue. Nothing in these Terms or the Waiver excludes or limits liability for gross negligence, recklessness, willful misconduct, fraud, intentional injury, violation of law, or any warranty, remedy, personal-injury claim, product-liability claim, or consumer right that applicable law does not permit to be excluded, released, or limited.

Some jurisdictions do not allow certain exclusions or limits. In that event, the affected provision applies only to the maximum extent permitted by law.

16. Narrow indemnity for intentional unlawful conduct

To the maximum extent permitted by law, you will indemnify Vocal Light only for damages and reasonable external costs finally awarded on a third-party claim directly caused by your intentional unlawful conduct or willful infringement of that third party’s intellectual-property rights.

You have no obligation concerning ordinary consumer use, an App defect, Vocal Light’s negligence or violation of law, or any claim that applicable law makes non-indemnifiable. No settlement may impose liability on you without your written consent.

17. Governing law and disputes

California law governs these Terms and the Waiver, without regard to conflict-of-law rules, except that non-waivable law of your state of residence applies where required.

Before filing a civil action, either party may request a good-faith informal discussion by using the Support URL on the App Store product page. Informal discussion is voluntary and does not shorten or waive a legal deadline.

Any dispute not resolved informally may be brought in a court that has personal and subject-matter jurisdiction. These Terms do not require mandatory arbitration and do not waive any right that applicable law makes non-waivable.

Nothing in these Terms prevents you from communicating with, filing a complaint with, or participating in a proceeding before a government agency.

18. General terms

These Terms, the Waiver, and the Apple Standard EULA constitute the complete contractual agreement governing use of the App. The Privacy Policy and Consumer Health Data Privacy Policy are notices rather than separate contracts, without limiting any obligation or right established by applicable privacy law. The Voice and Playback Safety Notice and Accuracy and Reliance Notice provide supplemental disclosures and are incorporated only where these Terms expressly refer to them. Any additional terms presented for a specific feature apply only to that feature.

If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain in effect, unless doing so would materially defeat the parties’ bargain. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a sale, reorganization, or transfer of the App, subject to applicable law.

Headings are for convenience only. “Including” means “including without limitation.” The singular includes the plural where context permits.

The in-App document reader provides a share control so you can save or share the current agreement text. After acceptance, Legal & Privacy provides a device-generated receipt containing the locally recorded agreement versions, hashes, acceptance date, App version/build, acceptance-screen version, and affirmation identifiers. The receipt does not contain microphone audio, pitch samples, or vocal-range values. Public copies are also available at https://vocallight.com/terms and https://vocallight.com/liability-waiver.
